Selon la Cour de cassation, le droit de l&rsquo;Union europ\u00e9enne consid\u00e8re que les cong\u00e9s pay\u00e9s ont pour but non seulement de permettre au salari\u00e9 de se reposer, mais aussi de b\u00e9n\u00e9ficier d&rsquo;un moment de d\u00e9tente et de loisirs. Cet objectif diff\u00e8re de celui de l&rsquo;arr\u00eat maladie : se soigner et se consacrer \u00e0 la gu\u00e9rison.<\/p>\n<p>Par ailleurs, \u00e0 la suite d&rsquo;un recours d\u00e9pos\u00e9 par trois salari\u00e9s, la Cour a reconnu le droit au paiement des heures suppl\u00e9mentaires pour un salari\u00e9 soumis \u00e0 un d\u00e9compte horaire, m\u00eame durant une semaine o\u00f9 un jour de cong\u00e9 pay\u00e9 a \u00e9t\u00e9 pris et o\u00f9 les 35 heures de travail effectif n&rsquo;ont donc pas \u00e9t\u00e9 atteintes.
