Par la suite, les parties ont conclu un accord transactionnel aux termes duquel l\u2019employeur s\u2019est engag\u00e9 \u00e0 payer au salari\u00e9 la somme de 72.000 euros et \u00e0 lui garantir, par le biais d\u2019une promesse de porte-fort, que les entreprises du groupe reprendraient des relations contractuelles avec ledit salari\u00e9 qui exer\u00e7ait \u00e0 titre lib\u00e9ral et ind\u00e9pendant<\/p>\n<p>En contrepartie, le salari\u00e9 a renonc\u00e9 \u00e0 l\u2019ex\u00e9cution du jugement prud\u2019homal. Cependant, faute de se voir proposer une quelconque mission, le salari\u00e9 a demand\u00e9 la r\u00e9solution judiciaire de la transaction et le versement de dommages-int\u00e9r\u00eats<\/p>\n<p>La Cour d\u2019appel a accueilli la demande en r\u00e9solution de la transaction, estimant que la convention contenant une promesse de porte-fort, \u00e9tait susceptible de r\u00e9solution en cas d\u2019inex\u00e9cution totale ou partielle et qu\u2019il n\u2019\u00e9tait pas contest\u00e9 qu\u2019aucune mission n\u2019avait \u00e9t\u00e9 propos\u00e9e \u00e0 l\u2019int\u00e9ress\u00e9. La promesse de porte-fort constituait ainsi, selon les juges du fond, un\u00e9l\u00e9ment essentiel de la transactiondont l\u2019inex\u00e9cution justifiait l\u2019an\u00e9antissement du contrat<\/p>\n<p>Saisie du pourvoi form\u00e9 par l\u2019employeur, la Cour de cassation a censur\u00e9 l\u2019arr\u00eat de la Cour d\u2019appel en rappelant que, conform\u00e9ment \u00e0 l\u2019ancien article 1120 du Code civil, l\u2019inex\u00e9cution d\u2019une promesse de porte-fort ne se r\u00e9sout que par la condamnation de son auteur \u00e0 desdommages-int\u00e9r\u00eats, la circonstance que la promesse de porte-fort soitconclue dans le cadre d\u2019une transactionest sans incidence<\/p>","protected":false},"excerpt":{"rendered":"<p>Cass. 1\u00e8re civ., 7 mars 2018, n\u00b0 15-21.24 Un employeur a \u00e9t\u00e9 condamn\u00e9 par une juridiction prud\u2019homale \u00e0 verser \u00e0 un salari\u00e9 la somme de 180.000 euros.
