{"id":1404,"date":"2018-01-30T00:00:00","date_gmt":"2018-01-30T00:00:00","guid":{"rendered":"https:\/\/wan-avocats.com\/bail-commercial-pas-de-resiliation-de-plein-droit-sans-lintervention-dun-huissier\/"},"modified":"2026-06-26T08:56:10","modified_gmt":"2026-06-26T08:56:10","slug":"bail-commercial-pas-de-resiliation-de-plein-droit-sans-lintervention-dun-huissier","status":"publish","type":"post","link":"https:\/\/wan-avocats.com\/en\/bail-commercial-pas-de-resiliation-de-plein-droit-sans-lintervention-dun-huissier\/","title":{"rendered":"Bail commercial : pas de r\u00e9siliation de plein droit sans l\u2019intervention d\u2019un huissier"},"content":{"rendered":"<p>La 3<sup>\u00e8me<\/sup> chambre civile de la Cour de cassation a rappel\u00e9 que la mise en \u0153uvre de la clause r\u00e9solutoire d\u2019un bail ne pouvait r\u00e9sulter que d\u2019un acte extrajudiciaire, autrement dit, de la d\u00e9livrance pr\u00e9alable d\u2019un commandement de payer par huissier de justice<\/p>\n<p>En l\u2019esp\u00e8ce, la juridiction d\u2019appel avait consid\u00e9r\u00e9 qu\u2019une lettre recommand\u00e9e valant sommation, remplissait les conditions l\u00e9gales lorsqu\u2019il en r\u00e9sultait une interpellation suffisante du d\u00e9biteur (rappel du d\u00e9tail de la dette + rappel du d\u00e9lai d\u2019un mois pour la r\u00e9gulariser + rappel qu\u2019\u00e0 d\u00e9faut de contestation dans le d\u00e9lai l\u00e9gal, le bail serait r\u00e9sili\u00e9 de plein droit).
