{"id":1364,"date":"2016-05-03T00:00:00","date_gmt":"2016-05-03T00:00:00","guid":{"rendered":"https:\/\/wan-avocats.com\/action-syndicale-cdd-et-atteinte-a-linteret-collectif-de-la-profession\/"},"modified":"2026-06-26T08:56:31","modified_gmt":"2026-06-26T08:56:31","slug":"action-syndicale-cdd-et-atteinte-a-linteret-collectif-de-la-profession","status":"publish","type":"post","link":"https:\/\/wan-avocats.com\/en\/action-syndicale-cdd-et-atteinte-a-linteret-collectif-de-la-profession\/","title":{"rendered":"Action syndicale: CDD et atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession"},"content":{"rendered":"<p>Par un arr\u00eat en date du 23 mars 2016, la Cour de cassation rappelle que la violation des dispositions l\u00e9gales relatives au contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e est de nature \u00e0 porter atteinte \u00e0 l&rsquo;int\u00e9r\u00eat collectif de la profession<\/p>\n<p>En l\u2019esp\u00e8ce, une salari\u00e9e a \u00e9t\u00e9 engag\u00e9e par la Poste, dans le cadre d\u2019une s\u00e9rie de contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e, puis quelques ann\u00e9es plus tard, dans le cadre d\u2019un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9. Elle sollicitait aupr\u00e8s du Conseil de prud\u2019hommes la requalification de ses contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, et ce, \u00e0 compter de la signature du contrat initial<\/p>\n<p>Le syndicat Sud poste Marne est intervenu volontairement \u00e0 l&rsquo;instance, et r\u00e9clame des dommages et int\u00e9r\u00eats au nom de l\u2019int\u00e9r\u00eat collectif de la profession et du pr\u00e9judice indirect qui en d\u00e9coule<\/p>\n<p>La Cour de cassation a tout d\u2019abord rappel\u00e9 que les effets de la requalification de contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e remontent \u00e0 la date de la conclusion du premier contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e irr\u00e9gulier, au visa de l\u2019article L 1254-1 du Code du Travail<\/p>\n<p>Mais elle a surtout rappel\u00e9 que, conform\u00e9ment \u00e0 l\u2019article L. 2132-3 du code du travail, le syndicat Sud poste Marne \u00e9tait dans son bon droit de r\u00e9clamer des dommages et int\u00e9r\u00eats car le fait pour l\u2019employeur de violer des dispositions l\u00e9gales porte atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession.
