{"id":1337,"date":"2015-07-06T00:00:00","date_gmt":"2015-07-06T00:00:00","guid":{"rendered":"https:\/\/wan-avocats.com\/requalification-du-contrat-de-mission-interimaire-en-cdi\/"},"modified":"2026-06-26T08:56:43","modified_gmt":"2026-06-26T08:56:43","slug":"requalification-du-contrat-de-mission-interimaire-en-cdi","status":"publish","type":"post","link":"https:\/\/wan-avocats.com\/en\/requalification-du-contrat-de-mission-interimaire-en-cdi\/","title":{"rendered":"Requalification du contrat de mission int\u00e9rimaire en CDI"},"content":{"rendered":"<p>Aux termes d\u2019un arr\u00eat dat\u00e9 du 3 juin 2015, la chambre sociale de la Cour de cassation a eu l\u2019occasion de confirmer sa jurisprudence relative \u00e0 la requalification du contrat de mission int\u00e9rimaire en CDI (Cass. soc., 3 juin 2015, 14-17705)<\/p>\n<p>En l\u2019esp\u00e8ce, une salari\u00e9e avait \u00e9t\u00e9 embauch\u00e9e par une soci\u00e9t\u00e9 afin d\u2019effectuer diverses missions temporaires successives entre le 17 juin 2002 et le 20 d\u00e9cembre 2009. Elle saisit donc la juridiction prud\u2019homale aux fins de requalification de ses contrats de travail temporaires en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e<\/p>\n<p>La Cour d\u2019appel la d\u00e9boute de sa demande au motif que le caract\u00e8re r\u00e9gulier de ces nombreux contrats, ne prouvait pas la volont\u00e9 de pourvoir durablement un emploi li\u00e9 \u00e0 l\u2019activit\u00e9 normale et permanente de l\u2019entreprise. En effet, la soci\u00e9t\u00e9 avait recours \u00e0 ces contrats afin de ne pas avoir \u00e0 former de nouveaux int\u00e9rimaires. En outre, les contrats pr\u00e9cisaient la mention \u00abaccroissement temporaire de l\u2019activit\u00e9\u00bb ou \u00abremplacement d\u2019un salari\u00e9 absent\u00bb<\/p>\n<p>La Chambre sociale casse la d\u00e9cision, consid\u00e9rant que la salari\u00e9e avait effectu\u00e9 les m\u00eames missions de manutention quel que soit le motif de recours au travail temporaire mentionn\u00e9.
