Pour eux, il appartenait \u00e0 la salari\u00e9e de d\u00e9montrer que ces agissements relevaient d&rsquo;une d\u00e9marche volontaire, destin\u00e9e \u00e0 l&rsquo;atteindre et permettant de pr\u00e9sumer l&rsquo;existence d&rsquo;un harc\u00e8lement<\/p>\n<p>La Cour de cassation censure cette d\u00e9cision. Elle consid\u00e8re que le harc\u00e8lement moral est constitu\u00e9 d\u00e8s lors que sont caract\u00e9ris\u00e9s des agissements r\u00e9p\u00e9t\u00e9s, et ce ind\u00e9pendamment de l&rsquo;intention de l&rsquo;auteur.
