La rupture conventionnelle est alors exclusive du licenciement ou de la d\u00e9mission et ne peut \u00eatre impos\u00e9e par l\u2019une ou l\u2019autre des parties.<\/p>\n<p>Elle r\u00e9sulte d\u2019une convention sign\u00e9e par les parties au contrat. A compter de la date de signature, chacune des deux parties dispose d\u2019un d\u00e9lai de r\u00e9tractation de 15 jours<\/p>\n<p>A l\u2019issu de ce d\u00e9lai, la partie la plus diligente adresse une demande d\u2019homologation \u00e0 l\u2019autorit\u00e9 administrative. Un d\u00e9lai d\u2019instruction de 15 jours s\u2019ouvre alors au profit de cette derni\u00e8re.
